These terms govern your use of Businessloans.org.nz (the “Site”). By using the Site you agree to these terms. If you do not agree, do not use the Site. These terms work alongside the Privacy Policy and the disclaimer band at the bottom of every page.
1. Indicative content and modelled figures
Everything on the Site is general information and indicative figures. All numbers shown by the calculator, in worked examples, in rate tables, and in case-study scenarios are indicative only and modelled from the inputs entered or from generic NZ market assumptions. The figures are not a quote, not an offer of credit, and not a guarantee of the rate, fees, term, or approval available to any specific business.
Final pricing, fees, security requirements, and approval decisions are set by the lender after the lender's own credit assessment of the applicant's business and any guarantor's circumstances. Indicative bands shown on the Site are derived from publicly available NZ lender information and primary regulatory sources, refreshed periodically. They will not always match the offer a particular borrower receives.
2. Not a lender, broker, or financial adviser
Businessloans.org.nz is not a registered lender, not a broker, and not a registered financial adviser under New Zealand law. We do not arrange credit, hold client money, or provide regulated financial advice as defined under the Financial Markets Conduct Act 2013 Part 6 or the Financial Services Legislation Amendment Act 2019 (FSLAA). Nothing on the Site is personalised financial advice for the purposes of those Acts.
We are not registered on the Financial Service Providers Register (FSPR) because the activities the Site performs (publishing class information and operating an indicative calculator) do not constitute a financial service as defined under the Financial Service Providers (Registration and Dispute Resolution) Act 2008. If our activities ever change in a way that brings us within scope, registration and dispute-resolution-scheme membership will be added before the change ships.
3. General information, not personalised advice
Content on the Site is general information (commonly described as “class information”). It does not take into account the financial situation, objectives, or needs of any particular business or person. Decisions about borrowing, security, term length, or repayment structure depend on factors specific to each business that the Site does not see.
Before making a borrowing decision, professional advice from a licensed Financial Advice Provider, a chartered accountant, or a solicitor is widely regarded as the safer frame, particularly where amounts are material or the borrowing involves a personal guarantee. Where this is mentioned in body content, it is general framing rather than personalised advice.
4. Partner referral and commercial relationship
The Site refers users who click the calculator's “see if you qualify” CTA to Prospa, an independent New Zealand SME finance partner. Businessloans.org.nz earns a referral commission from Prospa when a referred application converts to a funded loan. The commission is paid by Prospa, not by the borrower, and it does not change the rate, fees, or terms Prospa offers the business.
We do not claim Prospa is the cheapest or best lender for every applicant. Alternatives exist at the major banks (ANZ, ASB, BNZ, Westpac, Kiwibank), at asset-finance specialists (Heartland Bank, UDC Finance, Pioneer Finance), and at other alternative lenders. Borrowers comparing multiple offers is widely regarded as the safer frame for material amounts.
We do not warrant or guarantee Prospa's products, services, rates, or decisions. Those are the responsibility of Prospa. The full commercial-relationship disclosure is on the partner page.
5. Tax, GST, and accountant framing
Tax-treatment statements on the Site (GST claim timing, interest deductibility, depreciation rates, provisional tax interaction with finance interest, and similar) are general in nature and subject to confirmation by your accountant on the specific business position. Inland Revenue (IRD) is the primary source for any specific NZ tax-treatment question.
For material amounts, professional tax advice from a chartered accountant is widely regarded as the safer frame. The Site does not give and is not capable of giving personalised tax advice.
6. Fair dealing posture
The Site operates under the fair-dealing requirements of the Financial Markets Conduct Act 2013 Part 2 and the Fair Trading Act 1986. Together these Acts prohibit misleading or deceptive conduct, false representations, and unsubstantiated representations about financial products and services. The 2022 Fair Dealing amendments to the FMC Act extended this to unsubstantiated representations specifically.
Our editorial posture reflects this. Numeric or regulatory claims on the Site are hedged or sourced to a primary New Zealand authority (NZTA, MBIE, Inland Revenue, Reserve Bank of New Zealand, Stats NZ, Commerce Commission, Financial Markets Authority). We do not quote a specific rate as available, do not promise approval or approval speed, and do not claim Prospa is “best” or “cheapest” for every borrower.
7. Use of the Site
You may use the Site for personal and business research. You may not republish, scrape, scrape via automated means, or otherwise commercially exploit the content without written permission. The calculator and its underlying logic, the editorial content, the data files, the rate-band tables, and the design are the property of Businessloans.org.nz and protected by New Zealand copyright law.
Outbound links to lenders, regulators, and primary sources are provided for convenience. We do not control those destinations and are not responsible for content, accuracy, availability, or any commercial dealings on linked sites. Following an outbound link is at the user's own discretion.
8. Limitation of liability
To the maximum extent permitted by New Zealand law, Businessloans.org.nz, its operators, employees, and contributors are not liable for any loss or damage (including direct, indirect, consequential, special, exemplary, or incidental loss, loss of profits, loss of business, loss of data, or loss of goodwill) arising out of or in connection with use of the Site, reliance on its content, indicative figures, or third-party information, regardless of whether the loss arises in contract, tort (including negligence), equity, statute, or otherwise.
Final lender decisions are independent commercial decisions made by lenders after their own credit assessment. The Site has no role in, and accepts no responsibility for, the rate, fees, terms, conditions, decisions, or post-funding conduct of any lender. Statutory consumer guarantees and rights that cannot be excluded under New Zealand law are not affected by this clause.
9. Governing law and jurisdiction
These terms are governed by the laws of New Zealand. Any disputes arising from or in connection with the Site or these terms are to be resolved in the courts of New Zealand, and you submit to the non-exclusive jurisdiction of those courts.
10. Changes to these terms
We may update these terms from time to time. The “Last reviewed” date at the top of this page reflects the most recent change. Continued use of the Site after changes are published constitutes acceptance of the updated terms. Material changes (for example, a change to the partner-referral arrangement or to the limitation-of-liability clause) will be flagged in the disclaimer band on every page.
